TransCanada’s Keystone Wins Right to Take Pipeline Land

Businessweek -- TransCanada Corp. won court permission to build part of its Keystone XL pipeline across several contested tracts of southeast Texas farmland to carry Canadian tar-sands crude to Gulf Coast refineries.

State judge Tom Rugg Sr. granted the pipeline company’s requests to take possession of the tracts under state eminent- domain laws after a hearing today in Beaumont, Texas.

“The statutory requirements for the issuance of writs of possession are now met,” Rugg said in a two-page ruling, after TransCanada agreed to increase the size and type of surety bonds it posted in the proceeding.

The landowners urged Rugg to deny TransCanada’s access to the disputed tracts, citing a Texas Supreme Court ruling last year that limits the condemnation powers that pipelines can use under state law.

When did an "Easement" to put a pipe four feet under come to mean "Take"

Oh, I remember it was the New York Times that used the word "Confiscate" instead of easement when the New York Times was leading the charge against the pipeline. But of course the New York Times said they don't take sides.

Just remember, after the pipeline is laid four foot under, the farmer can plant his corn and the rancher can graze his cattle over the pipeline because the land is still his, it is an easement!

TransCanada’s Keystone Wins Right to Take Pipeline Land? What's wrong with this country, when an entity outside the US can take people’s land and get away with it!
Your Land is Your Land! As long as you pay the taxes, pay your mortgage and have been farming it for as long as you have - NOBODY has the right to take or use any part of Your Land without Your Approval!!! NOBODY! TransCanada Is a Bully and needs to be stopped, the pipeline needs to be rerouted, the judge needs to rule for the land owners AND get fired too! The US federal or state governments do Not have any right to the same kind of tactics as TransCanada or anybody else.
Big Oil will refine the crude oil at the Texas Gulf refineries and export the fuel to other countries that will pay more for it. Big Oil will build this pipeline and Nobody can say or do anything about it - Not Chucky, Not the affected land owners or anybody else. The oil pipeline from Cushing has already been approved, that pipeline will relieve the oil transportation bottle neck from there to the Gulf refineries.
There will be NO price reduction of fuel, at the pump, in the US from this oil pipeline.
Whatever the size or shape of the vehicle, Produce and ‘Drive’ vehicles with high MPG, are very reliable, have a ‘reasonable’ cost and a good ‘value’ for the money.
The price of fuel at the pump is too high!

no doubt it will go to appeal and the lawyers will continue to make lots of money for the attorney retirement funds. this can be tied up for years in the courts so nothing will be accomplished.

Good, the landowner is being compensated and will not lose the use of his property, the pipeline runs underground and are much less obtrusive than giant overhead electric transmission towers.

This pipeline is good for only "BIG OIL"! Canada needs to get their oil to port so it can be sold for a higher price... nothing else. We the USA will pay the price... Already there are farmers paying the price through eminent-domain! The pipe line is a bad deal.
